Pristanski, now legal counsel for the New York Islanders, wrote in his 2018 article for the DePaul Journal Sports of Law that hazardous activities clauses "fail to effectuate the parties' intent, and are difficult to interpret and apply," he was referring to all of the above. And yes, 4 years before the Snowboard Crash Heard 'Round The Track, he was also referring to Chase Elliott.

We can't praise Dale Earnhardt for his love of driving bulldozers and knocking down trees and crashing a horse down the side of a mountain in New Mexico with Richard Childress and then be irritated with Chase Elliot because he hit the slopes. We can't gleefully tell stories about Cale Yarborough being struck by lightning, fighting off a bear while flying an airplane and bouncing off the ground when his parachute didn't open and then act like Chase Elliott is irresponsible because he likes to turn ollies in the powder. And we surely should not be allowed to treat Chase Elliott as an old-school stock car thrill seeker when he moonlights in the SRX series each summer but then doubt his judgment because he snaps his boots onto a board in the winter.

No, Chase Elliott just had a bad day while participating in the hobby that he loves most. He will be back in his race car soon enough. Let him heal, both his leg and his pride. And in the meantime, let's turn the volume down on any chatter about rolling athletes in bubble wrap before they do anything other than their day job.

Besides, we all know what would happen next, especially when it comes to racers. They would go on and do it anyway, just to see how loud of a popping sound they could make.

Not aware of what all the chatter is, but two thoughts

1) if he doesn't have a contract that restricts certain things, then I agree, do your thing

2) I don't think he should be punished or anything, but I also don't think he should be granted any special allowances in regards to qualifying for the playoffs

Pretty sure NASCAR will grant the waiver. Can't think of a time that they haven't. Either way, it's going to be hard and interesting to see how this plays out. Chase is still going to have to earn the points and a win or two. Six weeks is a long time and he will be far behind. One could argue that this is his punishment. Just my two cents.

Don't know how this will turn out, but this is exactly what I expected long term for the newest driver of the #24. All kinds of things happen during races, where the best car doesn't win… or even finishes for that matter.

Welp. Didn't end up having the best car as it turned out... but we'll still take it I guess.

Honestly though, I loathe these late race cautions just as much as Larson and Harvick do, and would have been just fine with the 3rd / 4th place finish that the #24 was heading for.

BTW congrats to @MW55. He no longer owns the record for largest #NASCAR fine. Today's $400K pop to Hendrick Motorsports tops the $300K penalty dropped on Michael Waltrip Racing after the infamous fall 2013 Richmond postseason-altering mess.

NASCAR hammered Hendrick Motorsports for modifying air deflecting pieces by docking all of its Phoenix drivers and teams 100 regular-season points and 10 playoff points and suspending each of their crew chiefs for four races each and fining the crew chiefs $100,000.

It is the biggest combined fine to one organization in NASCAR history. NASCAR has issued bigger fines for individual violations but a $400,000 combined fine to one organization is the largest.

Kaulig Racing's Justin Haley and his team received the same penalty.

"It was obvious to us that these parts had been modified in an area that wasn't approved," NASCAR Senior Vice President of Competition Elton Sawyer said.

The hood louvers were taken by nascar on Saturday, therefore they had legal, replacement louvers in place for the race on Sunday. So, their finishes on Sunday are good, as the parts were confiscafed before the race.

On Wednesday, NASCAR announced that Denny Hamlin was penalized $50,000 and 25 driver points for intentional contact with Ross Chastain in the final laps of the Phoenix Cup Series race.

On his podcast, Actions Detrimental with Denny Hamlin, Hamlin was honest, revealing that he intentionally got into Chastain and squeezed him in between Hamlin's Toyota and the outside wall. Hamlin also said that the two came to a "truce" after the race, and are moving forward.

Many figured Hamlin's comments got him the penalty rather than the actual act, and they would be proven right. NASCAR SVP of Competition Elton Sawyer was on Sirius XM NASCAR Radio and confirmed that the sanctioning body would have viewed it as a "racing incident" until Hamlin spoke up about what happened.

Sawyer said, "We would've viewed that as a racing incident. But then as, 24 hours later, have a competitor that has gone on a podcast, which I will say, we're delighted that Denny has a podcast. We think that's great. Interacts with the fans. But when you start admitting that you have intentionally done something that would compromise the results of the end of the race, then that rises to a level that we're going to get involved."
