Wayland -- thanks as always. For you or Davie, 2 questions:

1) Seems the hospitalizations are actually headed downwards? low 800s even with 90+% reporting? Seems like it was hovering around 900 for a long while

2) Since Mandy made her proclamation about having a great plan for the LTCF, how many in those facilities have died?

ETA...one more...this another case where we can be told we are in the red zone (<1000 cases) despite 3.4% testing?

If you have a date, you can look at this chart. I manually track death by setting (reported) each day (there is setting by date of death available).

This is how many deaths were reported by setting in the week ending with the date listed.

Hospitalizations will continue to be tough. Since they include COVID positive patients that are not in for COVID related reasons (pregnancy, etc). As long as COVID remains and active virus and everyone is being tested there will be COVID hospitalizations both from and with. I hope to see ICU numbers decrease since this does represent the most severe of COVID cases.

As long as things continue to trend stable/down with hospitalizations that is very good since with space available, COVID patients will continue to get admitted to some degree with varying degrees of severity.

With regards to new weekly cases, by my calculations NC should be Yellow in the report for last week (9/13 report). If NC stays below 100 cases reported in a week per 100,000 population, it will not be in the Red condition. For example, in the report for the week of 9/6, NC was Red due to the fact the cases reported for the previous week totaled 11,751 which put NC at 112 per 100,000 population. Last week, NC only reported 8,035 cases, based on the data from NCDHHS, which is why I believe it will move to the Yellow status (should be a score of 77).

It would be nice if NCDHHS would share these reports. They get them from Dr. Birx's task force on a weekly basis. I have links to reports for week of 8/6, 8/23, 8/30, and 9/6. In the 8/30 report, they specifically reference the return of students to universities as a key driver of the increase. The weeks prior to the 8/30 report, NC was Yellow. I appears NC went into the red condition for two weeks and should now be Yellow again.

This is very good news. Thanks very much for the insight. I hope the census for ICU continues to stay low, since these are the patients who might have the worst outcomes.

Do you believe improvement in treatment protocols and medicines could be contributing to the reduction in ICU census and more particularly to the reduction in patients who are tubed?

I think it's multifactorial. Certainly, i think we're managing the disease a little better as we learn more, but i also think disease demographics have changed, and in general the population that gets infected is getting less severe disease.

This may be a question that requires more insight than most of us can provide, but my understanding of most viruses is that they infect to live, not to kill the host. Do you think there are more severe strains of it that have killed more but in killing that person may be less replicated, leaving us with milder versions of it?

Conclusion

The Court closes this Opinion as it began, by recognizing that Defendants actions at issue here were undertaken with the good intention of addressing a public health emergency. But even in an emergency, the authority of government is not unfettered. The liberties protected by the Constitution are not fair-weather freedoms--in place when times are good but able to be cast aside in times of trouble. There is no question that this Country has faced, and will face emergencies of every sort. But the solution to a national crisis can never be permitted to supersede the commitment to individual liberty that stands as the foundation of the American experiment. The Constitution cannot accept the concept of a "new normal" where the basic liberties of the people can be subordinated to open-ended emergency mitigation measures. Rather, the Constitution sets certain lines that may not be crossed, even in an emergency. Actions taken by Defendants crossed those lines. It is the duty of the Court to declare those actions unconstitutional. Thus, consistent with the reasons set forth above, the Court will enter judgment in favor of Plaintiffs.

Candace Owens said literally the same thing 6 months ago when this all began. And I agree. Always easy to make decisions in hindsight, but After the initial 6-8 weeks when it was evident that hospitals would not be overrun and everybody wasn't going to die it was in the country's best interest to open back up. This is why any candidate that wants to expand federal government oversight, including "affordable" healthcare to all, increase regulations, and increase government spending will never get my vote. Most things the federal government touches are an abject failure, Yet Here's Biden running national slots about national mask mandates. Lol can't make it up.

The fact that Meck County initially claimed the mistake was a scam just adds to the ever eroding trust of public officials.

A lot of mistakes have been made by public officials in the last 6 months that need to be owned up to.

I'm sure there's probably been a **** ton of coronavirus cases reported in this state that were not correct... and I personally don't think it is by accident either for whatever that's worth.

The fact that the shutdowns were supposed to be just to ensure hospitals were not overrun has been a discussion point that has come up again recently. The goalposts have been moved so many times that most people have forgotten that was the stated purpose.

It goes back to Butler County v. Wolf and the fact that people all around the country need to seize the opportunity to use that judgment to take power back away from authoritarian governors.

And I am not arguing for ZERO mitigation efforts, I am just saying governors have gone too far in issuing unilateral orders.

It's going to take years to sort through this mess and uncover just how nefarious some of the intentions were regarding the power grabbing, the loss of freedoms, the manipulation of data, and the constant fear porn message. This has turned into one giant experiment to see how quickly you could bring America to it's knees. Very, very quickly and folds as easy as a cheap suit.

The one that most directly affects me is Cooper's limit of 50 people in a 30,000-50,000 seat outdoor stadium. Why can't he allow 1,000 player parents into the stadium? Power and optics. It has nothing at all to do with science and flattening the curve. This weekend, I will miss one of my son's game for the first time - something I have not done since he began playing sports at the age of 4 (I also never missed a band concert or play). The game is being played in a stadium where he has attended games from the time he is born (of course he plays for the visiting team now) and one that is located 25 minutes drive from my house. Due to Cooper's failure to do the right thing, I have to watch my son on play on television.

Last week, Mandy Cohen tried to justify the limits on fans at games by pointing out that NC is in the Red status on Dr. Birx's Coronavirus Task Force's measurement of cases. Based on the total cases for last week (week ending 9/12), NC should be Yellow again, meaning NC was in the Red status for two weeks and a large portion of the increase was driven by the return to school for some of the larger universities in NC. The fact the growth came from the universities is highlighted in the report for 8/30.

34 more congregate deaths? Cohen's plan doesn't seem to be very effective. Seems that should be drawing her attention, not parents at CFB games.

Well you know she doesn't think football should be played during a pandemic. The parents not going is not her fault you see.
