Miller being downright horny over the opportunity to run down a brown Muslim judge named "Mustafa" notwithstanding, Kasubhai isn't "foreign-born" unless somehow Los Angeles is a different country. He was born in LA and went to Berkeley and University of Oregon.
And he's not "blocking the Trump Administration from requiring Democrat-run states to remove non-citizens from SNAP." His ruling doesn't change that requirement at all.
He's simply not allowing the Trump Administration to ignore the 120-day compliance grace period before fining allegedly non-compliant states millions of dollars.
The Trump Administration was trying to back-date the start of the grace period months prior to final guidance being issued (which occurred on December 10). Kasubhai is simply saying the 120-day grace period to implement changes begins on the day the Administration issued final guidance, which was December 10. States therefore have until April 9 to be in compliance.
Civ, you know two different things can be true at the same time. Now, I don't know the details of this ruling and really don't want to spend time learning about it. A couple of thoughts:
- So, we do have non-citizens receiving unlawful benefits?
- Why would there be a 120 day moratorium of an illegal distribution of services that some say don't exist?
- Miller's comments weren't wrong. Perhaps you don't like them; however, is he really amplifying a sentiment that doesn't have support?

You're a little twisted on the details of the SNAP distribution.
Benefits weren't previously being illegally distributed; they were being legally distributed in accordance with the law as written prior to the BBB.
The 120-day grace period to implement eligibility changes was written into the BBB and makes sense - government agencies can't shift procedures and logistics affecting millions of people at the drop of a hat.
On October 31 the USDA issued updated guidance that detailed changes (narrowing) of eligibility standards and implemented massive state penalties for non-complying states. On November 1 it announced it was also ending the 120-day grace period which would have made states immediately subject to massive fines even though guidance about the new standard had only been offered one day prior.
Sufficiently clear, final guidance was finally offered on December 10.
The court applying a reasonableness threshold to the eligibility shift implementation timing is not an unexpected or unreasonable outcome.

Regarding the BBB having (new) guidelines was only done because people, like you, swear that no illegals get government services. Well, that's what your party says, if not you. So, basically, something that most likely is already codified had to be codified again.
