You seem to be missing the part where the courts checked Biden's power with his first debt relief attempt, so he found a different, more directed, legal way to accomplish some of the same things.
That's how this all works. Presidents sometimes overreach, courts check their power, and if they want the Presidents can then figure out a different, legal way to accomplish what they're trying to accomplish.
Vance seems to be flailing on the history chapter where yes, it is definitely and obviously the courts that decide whether a President is overreaching.
Just like the courts did in Trump's first term with his overreach on immigration (travel ban); DACA; family separation; census citizenship questions; border wall funding; Presidential financial record shielding; Presidential records release under subpoena; TPS for immigrants; and COVID voting logistics.
