Here in lies the crux of the issue, you can't turn away patients. This is going to be an unpopular opinion, but what if as a stop gap UNTIL there is better immigration policy (by this I mean increasing visas) to allow for Urgent Cares to bill Medicad for illegal immigrant patients? Is far cheaper than the ER and also relieves pressures on Hospital systems.
Seems like a pretty decent compromise for now. You could package this with an immigration bill and it would be a win for everyone.

i was just adding to your discussion, not accusing you of anything. My apologies if it came across that way. I agree, it's a huge issue, especially here in NC and rural county hospital systems.
Its a massive issue across the country. Ive worked with plenty of hospitals that have issues with the ER not being able to legally turn people away. That is a law that gets taken advantage of massively.
People always want to talk about lowering healthcare costs, but no one wants to have the hard conversation about what that will actually entail. A LOT of hard decisions would need to be made that many will see as inhumane.
One of my big questions is that by law it seems ER's can discharge you or refer you, they just have to screen you to see if you need stabilization or emergency care.
The way the law is written it doesn't require that an ER admit you for a hangnail or a common cold, nor should it.
So to say ER's "can't turn you away" isn't nuanced enough; its seems like they legally can and should if your condition isn't serious, but I'd love to hear from any medical professionals on here about how ER screening is performed so as not to admit patients to the ER that don't require emergency care or stabilization.
Well, in your example, the hang nail/common cold patients get triaged and wait forever and usually eventually leave. The issue is more that people will complain with much worse "issues" to take advantage of the system. One place in New Jersey I worked had issues with homeless people complaining of chest pain to get admitted for a warm place to sleep and a meal. Another place I worked in Philly had parents who would bring their kids in on Friday saying they had a seizure so the kids would get admitted for observation to basically serve as a babysitter for their kids over the weekend. People learn what to complain about to specifically get the outcome they want.
