OK, so show some evidence to the contrary. It's not like the Archives had a list of every classified document missing from the Trump administration - in fact, there are some that still haven't been identified because they were removed from their folders. (Remember the dozens of empty folders marked classified found in the Mar-a-Lago search?) Rather, there were some high-profile classified materials that the Archives knew were missing and requested. If Trump had responded by returning those items promptly and then promptly searched for other classified documents so they could be returned then most likely nobody would have paid much attention. He didn't, which is what led to the need for a search by the FBI.
So documents were found before the midterms but that information was kept quiet.

President Trump's home was raided by the FBI about documents they knew he had and was working on returning them.

Then.. a SECOND set of documents have been found in Sleepy Joe's possession. Still no FBI raid.

And low and behold.... the documents that were found first have to do with Hunter's emails and Ukraine...

As I said in the other thread (Does this issue need it's own thread?), I would be interested in reading more about how the Biden documents relate to Hunter Biden emails. A quick google search didn't turn up any new reporting, but maybe I missed it.

None of the things you posted contain evidence that the classified documents had to do with Hunter Biden emails. (The Fox article talked about Hunter Biden emails relating to the Biden Center, but not anything saying the classified documents had to do with Hunter Biden emails.) Did you mean to post something else?

Not sure what point you're trying to get at. The way BBW throws around the term "Marxist" has always seemed indiscriminate to me (for lack of a better term coming to mind). I'm willing to cop to that being because I don't know what BBW means by the term. Maybe he can enlighten us with his definition and then I'll be in a better position to tell if he's applying it consistently. It's never a good thing if classified documents are not handled properly. However, the severity and willfullness of the conduct here, so far, appears much different than any other recent cases you might be thinking of.
In October of 2020, Steve Cortes did, one of his Chalk Talks, stating that PA University received 70M+, from the CCP, to build this facility, among a few other things. In return, Biden received a ~1M salary, as a professor, that he never did! In fact, it's being reported that he walked on campus, just four times. Oh, that's right... it was COVID time and couldn't make an appearance...

Manny, all of your BS has ONE major flaw... as VP, Joe Biden, or his staff, committed a felony by removing those documents. Trump, on the other hand, did not. As President, he can de-classify anything at anytime.

My stance is clearly there is an issue with how classified documents are handled, it's not a Trump thing, or a Biden thing, or a Hillary thing. It's something that I believe needs to be addressed immediately. The ambiguity of the laws are causing this problem

However, I really do not care about the back and forth political vomiting of gotcha moments and grandstanding by both parties. So I'm not really interested in the theater from both parties and some on this site, and I'd rather focus on fixing the issue so it does t happen again and moving on to other things.

At the end of the day, no one is going to be indicted for anything, Trump or Biden

So, as long as we have laws, they should be enforced, regardless. Until laws are repealed or modified (I'm looking at you tax code), we have to follow them.

If, somehow, it was established that either Trump or Biden was personally responsible for, or knowledgeable of, the movement of classified documents outside of the proper custody then each would be liable under whatever law applies. If Trump wanted to then raise a defense that the documents were declassified then he would have the burden of supporting that defense. That would be an uphill battle considering that no evidence of declassification of the Mar-a-Lago documents has been seen in the months since the FBI search. I agree that such a potential defense would not be available to Biden.

But, that's where the similarity ends.

What has Biden done since the first documents were found in November? Has he done anything other than report and return those documents and then search other locations to see if other documents could be found (which were also promptly reported and returned)? What has he done since then and what laws were potentially violated?

What did Trump do after the Archives alerted him that documents and other items were missing? What did he do after the subpoena? What laws were potentially violated? The Mar-a-Lago search warrant and affidavit provide a good road map to that.

Not sure what you're granting me "ten attempts" to do, but here's one. This is a long post, so dig in.

I'm not sure what has led you to believe that the Presidential Records Act (PRA) applies to the president and the Federal Records Act (FRA) applies to the Vice President, or that the two laws differ in that violation of the FRA is a felony but the PRA isn't. Neither of those is true.

The PRA (44 USC 22 2201-2209) applies to the handling of presidential records and vice presidential records (see 2207). It applies equally to the president and Vice President (among other people).

The FRA (44 USC 31 3101-3107 ) applies to federal agencies and agency heads. Courts have been consistent in finding that the White House is not a federal agency and that POTUS and VP are not agency heads. So, the FRA does not apply to presidential records handled (or mishandled) by Biden or Trump.

Neither the PRA nor the FRA are limited to classified documents, so even presidential records that were previously classified but are no longer classified still fall under those laws.

More importantly, neither the PRA nor the FRA include a criminal enforcement mechanism. That mechanism is found in 18 U.S. Code 2071 , which states:

Quote:

(a)Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both.

(b)Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term "office" does not include the office held by any person as a retired officer of the Armed Forces of the United States.
Again, nothing in this law is limited by or relates to the classification of the listed items or documents. If something fell under the PRA or 18 U.S. Code 2071 before is was declassified, it still does after it was declassified.

The terms "willfully" and "with intent to" present a high bar for a prosecutor, particularly up to the point where the existence of listed items or documents becomes known, because you would have to have prove that a person knew they were "taking and carrying away" listed items or documents. It is not enough to show that someone knew that a box was in an office closet, or in a garage, or in a home in Florida. You have to show that the person knew the contents of the box. You would have to have a paper trail or witnesses showing that the person knew about the contents of the boxes prior to the discovery of listed items or documents in the boxes. No such paper trail or witnesses exist for the Biden or Trump documents prior to the discovery of the documents.

One way to show willfulness, though, is to give someone notice, such as by informing them that a document or other item is missing from where it should be (e.g., the Archives) and that it is in their possession. Or someone in their employ could inform them about the item or document and then inform the DOJ/FBI. Or the DOJ could serve a subpoena requesting the return of documents or items.

Once someone is on notice of items or documents, how they behave will affect whether they act willfully or not. If they report and return the items or documents promptly, then that will weigh against willfulness. If they refuse to return the item, response incompletely to a subpoena, make a false statement (themselves or through an attorney) that all of the items and documents were returned, move items or documents from where they were after the person was on notice, etc., then that may weigh towards willfulness.

So far, Biden actions after being on notice appear to weigh against willfulness. Trump's actions do not.

Manny, respectfully I disagree with your stance. Of the documents we know about that were in a locked storage container in his UPenn office, the classified documents were in a manilla envelope in a folder marked "personal". They have been missing for 6 years. And then only called the National Archives AFTER the mid-term election. We do not know yet what manner the classified documents found next to Biden's Corvette had been stored securely or not.

So, having documents illegally stored for 6 years and then calling the National Archives saying hey, we found these documents is not a question of intent. You are excusing the concerning handling of secret documents because you think he did a better job of cooperating than Trump did.

Here's the analogy I'll make. If your predecessor was convicted of robbing banks, that doesn't mean that all crimes that have a punishment standard below robbing banks are all of a sudden legal.

I still maintain that there is a lot of information still not known that needs to see the light of day, but intent of either party is a distraction to the real issues here.

Manny, as I understand it... there were compartmented documents, in this group. These compartmented documents were to be maintained in a SCIF (Sensitive Compartmented Information Facility) Also, as I understand it... these documents will come to the person directly, not to the person office.

So, these people will have sole responsibility for the documents. Anyway you look at it, documents found, as compartmented, have a custody requirement.
