I responded to each Cary's comments in the bullet list. How much Biden was paid by UPenn, and for how much work, is not relevant to the questions of classified documents as they relate to Trump and Biden, so I did not comment.

I don't really need to insinuate anything about what felonies Trump may have committed. The Mar-a-Lago search warrant and supporting affidavit assert, and a federal judge agreed, that there was probable cause to believe that offenses may have been commited under any of 18 U.S.C. 793, 2071, and 1519, and that evidence of those offenses may be found in the areas of Mar-a-Lago to be searched.

We discussed 18 U.S.C. 793 extensively in the Mar-a-Lago thread. Offenses under that statute, in particular, do not require that the documents be classified. One theory of Trump's liability under 18 U.S.C. 793 is section (d):

In response to Gulfstream above, I gave a long list of what appear to be differences between the Trump and Biden circumstances. I stand by that.

Not only did the FBI have probable cause to believe that additional document may be found, additional documents were found. That was after months of requests from the Archives, a subpoena for any remaining documents, and a sworn statement from Trump's attorney that all remaining documents had been returned, so yes, there was a pattern suggesting that requests and subpoenas would not result in the return of all documents. The FBI affidavit provided information from a source in Mar-a-Lago that the boxes containing classified documents had been moved to and from the locked storage room. That could be considered actions to conceal those documents.

Which of those are true of Biden at this point? (Hint: none.)

And there remains no evidence that he actually did so, including by informing anyone in the White House that he did so. Beyond that, Biden is now President. Maybe he has declassified those document, too. Fact remains that the Biden were in a location authorized to hold administration records, not in a desk in his house.
  • That Biden, or anyone in his employ, moved the documents between locations after being aware that the Archives/FBI/DOJ were seeking their return - You have no idea whether that's true or not!
I'm saying that nothing like that has been alleged with respect to Biden.
  • That Biden, himself or through attorneys, made false statements to the FBI/DOJ regarding possession of any classified documents and the diligence of a search for such documents - FBI and the DOJ have "NO" credibility, especially after the Twitter files
The document signed by Trump's attorney has been made public and has not been disputed.
  • That Biden publicly complained that the classified documents here his personal property - He can't!!!! Trump can!!! One's a VP and one is a President!!!
It would be false for either of them to claim the documents as their personal property, even if they were somehow declassified. Presidential administration records are not personal property. Difference is that Biden has never claimed otherwise.
  • That the classified documents include any classified at the highest levels requiring specialized compartmented access - NOT TRUE!!!!

It's never a good thing if classified documents are not handled properly. However, the severity and willfullness of the conduct here, so far, appears much different than any other recent cases you might be thinking of.
In October of 2020, Steve Cortes did, one of his Chalk Talks, stating that PA University received 70M+, from the CCP, to build this facility, among a few other things. In return, Biden received a ~1M salary, as a professor, that he never did! In fact, it's being reported that he walked on campus, just four times. Oh, that's right... it was COVID time and couldn't make an appearance...

I responded to each Cary's comments in the bullet list. How much Biden was paid by UPenn, and for how much work, is not relevant to the questions of classified documents as they relate to Trump and Biden, so I did not comment.

I don't really need to insinuate anything about what felonies Trump may have committed. The Mar-a-Lago search warrant and supporting affidavit assert, and a federal judge agreed, that there was probable cause to believe that offenses may have been commited under any of 18 U.S.C. 793, 2071, and 1519, and that evidence of those offenses may be found in the areas of Mar-a-Lago to be searched.

We discussed 18 U.S.C. 793 extensively in the Mar-a-Lago thread. Offenses under that statute, in particular, do not require that the documents be classified. One theory of Trump's liability under 18 U.S.C. 793 is section (d):

It depends:
  • Does the FBI have probable cause to believe that additional documents will be found in those locations? What was the probable cause for the FBI to believe classified documents were in Melanie's closet? Barron's bedroom, dresser, closet etc...?
  • Has there been a pattern of activity relating to those locations and classified documents that suggests that merely requesting or presenting a formal subpoena for the return of any additional documents would not result in the return of all classified documents at those locations? Was there for Trump?
  • Does the FBI have any information suggesting that actions have been take to conceal the presence of classified documents at those locations? Did they for Trump?

Unless the answers to those questions is "yes," then I would say they should not.

A VP cannot declassify documents.........as stipulated in the Federal Records Act, which IS CRIMINAL

You know, if some of these TDS people would spend time understanding what these MAGA people stand for, they would realize Trump is nothing more than a figurehead. It's about the fundamental structure of this country.!
